POLICE ARREST SUSPECT ON HIS SEVENTH PROBATION REVOCATION PETITION

Mobile Police have made numerous felony and misdemeanor arrests of defendant Ray Charles Garrett for various criminal offenses including Homicide, Burglary, Possession of Burglar's Tools, Receiving Stolen Property, Possession of Drug Paraphernalia, Theft of Property, Possession of Forged Instrument, and Unlawful Breaking and Entering of a Vehicle dating back to 1985. Garrett was placed on formal probation with the State of Alabama back in 2003 and has since continued to commit criminal offenses and not met the conditions of his probation.

Since 2003, Garrett has been arrested and convicted of two felony and three misdemeanor cases. Garrett's probation officer has filed six petitions to revoke his probation following new arrests which coupled Garrett not meeting the defined terms of his probation. These violated terms include Garrett not reporting, not paying fines, not having an established residence, being arrested for new offenses, etc. Garrett's probation has been extended/ re-instated each time he has been arrested on a writ of arrest issued by his probation officer. Garrett is a career criminal and has continuously been a nuisance for law enforcement authorities who have done their jobs by investigating and arresting him on incidents where has been revealed as a suspect, and by the State of Alabama Probation/ Parole Office who has done their job by filing these petitions to revoke Garrett's probation on numerous occasions. Garrett owes approximately $17,225 to the state in the sum of fines and restitution. Garrett's history of arrest and notations of his probation revocations are listed below.

10/22/2002 Arrested in Mobile for Possession of Forged Instrument 2nd. Bond set at $3,000 cash/ corporate surety bond and the case was later nolle prossed by the DA offices.

03/10/2003 Arrested in Mobile for Unlawful Breaking and Entering of a Vehicle, he received a $3,000 cash/ corporate surety bond and was released on 11/26/2003.

08/25/2003 Plead guilt in Breaking and Entering/ Fraudulent Use of Credit Card.

Sentenced to 5 years probation with time served, probation was set to expire on 09/17/2008

05/18/2004 Probation Officer filed for delinquency for failure to report.

09/01/2005 Arrested by Mobile Police for Theft of Property First Degree, and two probation revocation warrants, no bond was issued due to the two revocation warrants and held.

09/20/2005 Theft First case bound over to the grand jury

03/03/2006 Plead guilt to Theft of Property First Degree

Judge McRae reinstated formal probation sentencing him to 10 years to time 6 months and to balance on probation. Also order to pay in 13519.60 in fines Probation expires 03/03/2011. He was released on the Theft of Property First Degree charge on this date due to the newly reinstated terms of probation.

07/05/2006 Arrested by Mobile Police for Burglary Third Degree/ Possession of Burglary Tools/ Attempt Burglary Third and Receiving Stolen Property Second Degree, Probation Violation Warrant and held by order of the court.

02/15/2007 Burglary Third Degree/ Possession of Burglary Tools Attempt Burglary Third and Receiving Stolen Property Second Degree case from 7/5/2006 was nolle prossed by DA's office in Judge Smith's court. An order review for his probation revocation and payment was set for March 22, 2007. He still owed the state 17225.50 in fines that are unpaid during this time.

04/05/2007 Judge Roderick Stout reinstated his probation and ordered his release from jail.

03/25/2008 Arrested by Mobile Police for Drug Paraphernalia/ Public Intoxication. He was released and given time served in municipal court.

05/04/2008 Arrested by Mobile Police for Possession of Burglary Tools/ Drug Paraphernalia. He was given credit for time served and released in District Court.

07/12/2008 Arrested by Mobile Police for Possession of Burglary Tools. He was remanded to custody

07/14/2008 The Possession of Burglary Tools from 5/04/08 case was nolle prossed by the District Attorneys Office and given time served for the Drug Paraphernalia. On 7/19/08 his Probation Officer filed a delinquency report and writ of arrest and Garrett was held until release on 10/23/2008.

10/23/2008 Judge Robert Smith sentenced to 15 years split to serve 3 months on the Possession of Burglary Tools. Judge Smith extended his probation until 10/22/2013.

11/24/2008 Arrested by Mobile Police for Receiving Stolen Property Third. He also never reported to his probation officer. Case was nolle prossed in Municipal Court.

02/05/2009 Released from Metro and has yet to report to his probation officer and pay 17225.50 in the fines owed to the state.

03/12/2009 Arrested by Mobile Police for two probation revocation for not reporting to his probation officer

*Garrett has been arrested 6 times on Probation Violation / Revocation Warrants issued out of Circuit Court dating back to 2004.*
